MegaFlash Models Inc. (“MegaFlash”) hosts user-submitted photos and profile materials. Users, not MegaFlash, are responsible for the content they upload. This page designates MegaFlash’s agent to receive notifications of claimed copyright infringement under 17 U.S.C. § 512.

User-submitted content

By creating a profile, uploading images, or submitting materials, you represent that you own the copyright in that material or have express permission from the copyright owner to upload and display it on MegaFlash. You agree MegaFlash may remove material upon notice of claimed infringement. You agree to indemnify and hold MegaFlash Models Inc. harmless from claims, damages, costs, and attorney’s fees arising from content you upload or from your breach of this representation.

Notification of claimed infringement

To be effective, a written notice to the designated agent should include:

Upon receipt of a valid notice, MegaFlash Models Inc. will act expeditiously to remove or disable public access to the identified material and its public derivatives (including thumbnails and cached public copies) while preserving private evidence, and will notify the user who posted it when that account can be identified.

Counter-notification

If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notification to the same agent including: your signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the Federal District Court for your address (or for the Middle District of Florida if outside the United States) and that you will accept service from the original complainant. Restore timing is set by counsel, not by this page.

Repeat infringers

MegaFlash Models Inc. will terminate, in appropriate circumstances after review, the accounts of users who are repeat infringers. There is no automatic strike count. Each notice is reviewed on its facts.
