1. Assumption of Risk & Release of Liability
By participating in any casting, assignment, or booking through MegaFlash Models Inc. (including MegaFlash Models / Shockwave Models), you voluntarily assume all risks associated with hair cutting, coloring, bleaching, chemical treatments, styling, photography, video, travel, backstage environments, or live/recorded presentations. These may include irreversible hair damage, skin irritation, allergic reactions, or personal injury. You release, indemnify, and hold harmless MegaFlash Models Inc., its owners, agents, clients, affiliates, and representatives from any claims, damages, or expenses arising from your participation, to the fullest extent permitted by law.
2. Hair & Chemical Service Consent
You consent to any requested hair or appearance changes and acknowledge results are not guaranteed and may be irreversible. You are solely responsible for disclosing any known allergies, sensitivities, scalp conditions, or prior chemical treatments before any service.
3. Photo, Video & Media Release
You grant MegaFlash Models Inc. and its clients irrevocable, perpetual rights to photograph, record, and use your likeness, image, voice, and appearance in all media formats including social media, advertising, editorial, and educational content unless otherwise specified in writing for a specific project.
4. Independent Contractor Status
All models participate as independent contractors on a per-project basis. MegaFlash Models facilitates casting and booking opportunities and may provide model management support, but does not employ or exclusively represent talent. You are responsible for your own taxes, insurance, and income reporting. No employment benefits, workers' compensation, or guarantees are provided.
5. No Guarantee of Booking or Representation
Application, profile creation, database inclusion, casting notices, or submissions do not guarantee selection, booking, payment, or project participation. MegaFlash Models operates as a casting agency and provides model management support but does not provide traditional exclusive modeling agency representation.
6. Non-Circumvention & Repeat Bookings
When MegaFlash Models Inc. introduces, submits, casts, or books a model for a client, brand, production, event, or project, that introduction or submission is provided as part of MegaFlash Models Inc.’s paid placement services.
For a period of twelve (12) months following any such introduction, submission, casting, booking, or confirmed job facilitated by MegaFlash Models Inc., any additional, repeat, extended, continued, or related booking or engagement between the same client (or its affiliates or successors) and the model that arises from, relates to, or results from MegaFlash Models Inc.’s involvement shall be arranged and invoiced exclusively through MegaFlash Models Inc. and shall remain subject to MegaFlash Models Inc.’s standard agency fees, placement fees, and/or commissions.
This provision applies only to opportunities originating through or facilitated by MegaFlash Models Inc. It does not restrict a model from independently pursuing or accepting unrelated work, does not prevent a client from hiring other talent through other sources, and does not create an exclusive representation or agency relationship.
Any direct or indirect arrangement intended to bypass MegaFlash Models Inc., avoid applicable agency fees or commissions, or interfere with MegaFlash Models Inc.’s right to compensation shall constitute a material breach of these Terms.
7. Indemnification
You agree to indemnify and hold harmless MegaFlash Models Inc. from any claims resulting from misrepresentation, failure to disclose relevant conditions, or failure to meet professional obligations.
8. Professional Conduct
You agree to maintain professional behavior, arrive prepared, and follow reasonable direction. Failure to do so may result in removal from an assignment and forfeiture of payment.
9. Governing Terms
These terms may be updated at any time. Continued participation in castings or bookings constitutes acceptance of the current terms. These terms are governed by the laws of the State of Florida.

By participating in any casting, submission, or booking, you confirm that you have read, understood, and agree to these terms.
10. Communication & Email Consent (Platform Requirement)
By creating a profile, submitting an application, or participating in any casting through MegaFlash Models Inc., you expressly consent to receive email communications related to castings, bookings, opportunities, and platform updates.
Email communication is a core operational requirement of the platform. If you opt out of, block, or fail to receive these communications for any reason, you may not be considered for opportunities and your profile may be removed at the sole discretion of MegaFlash Models Inc.
MegaFlash Models Inc. is not responsible for missed opportunities due to email filtering, inbox settings, provider restrictions, or user opt-out actions.
